Florida teen pleads guilty to brutal attack on teacher over Nintendo Switch

A Florida teen who violently assaulted a teacher's aide for confiscating his Nintendo Switch video game at school has pleaded guilty to the crime and could face up to 30 years in prison.


Brendan Depa, 18, entered a no contest plea to a first-degree felony charge of aggravated battery on an elected official or education employee on Monday, according to online records. Depa was 17 when he attacked Joan Naydich, a paraprofessional at Matanzas High School in Palm Coast, on Feb. 21, 2023.


The incident, which was captured on surveillance video and went viral online, showed Depa running up to Naydich, pushing her to the ground, and then punching and kicking her more than a dozen times in the back and head. Naydich suffered two broken ribs and multiple bruises as a result of the attack.


Depa, who is reportedly autistic and stands 6-foot-6 and weighs 270 pounds, was angry that Naydich had taken away his Nintendo Switch during class. He also threatened to kill her after he was taken into custody by the Flagler County Sheriff's Office.


Depa was initially charged as a juvenile, but the case was later transferred to adult court. His sentencing hearing is scheduled for Jan. 31, 2023, before Circuit Judge Terence Perkins. Perkins has wide discretion in determining Depa's punishment, which could range from probation to 30 years in prison.


Depa's attorney, Kurt Teifke, said his client is "doing well" and that he will present evidence of his mental condition and other mitigating factors at the sentencing hearing. Depa is still being held at the Flagler County Jail on $1 million bond.


Naydich, who is expected to testify at the sentencing hearing, has declined to participate in any effort to reduce Depa's sentence. She has also obtained a permanent injunction for protection against him. She said she hopes that the awareness of the incident will prevent anyone else from experiencing the trauma and disruption of life that she has endured.


"I'm hopeful that the awareness of this incident being spread far and wide will prevent anyone else from ever dealing with the trauma, physical healing and disruption of everyday life this has caused," she said on a GoFundMe page that has raised more than $104,000.


The attack on Naydich sparked outrage and concern among the public and the education community. The Flagler County School District said it has taken steps to ensure the safety and well-being of its staff and students.
